Abstract

Elissé, Isabelle, and Hilaire Pérot, free people of color, represent that their late mother, Marie Cydalise Pérot, a free woman of color, owned “considerable moveable and immoveable property,” valued at $500, exclusive of two promissory notes of unknown amounts. At the time of Marie Cydalise’s death, the three children were minors and Joseph Chrysostome Pérot, a free man of color, was appointed their tutor and administrator of the estate, for which he posted a $1,000 bond. The Pérot children claim that, as tutor and administrator, Joseph Chrysostome Pérot has not only collected $700 from the sale of their mother’s property and $270 from an unpaid debt, but he has also received $700 from the succession of their grandmother, Pelagie Grappe. The children contend that they have now reached the age of majority and they want Joseph Chrysostome to render an account of his administration and tutorship, something he has so far failed to do. They therefore pray for an order directing Joseph Chrysostome to render an account of his administration or to forfeit his bond if he fails to comply. They further seek a judgment against him for the money collected during his administration and claim a mortgage on his property to secure their rights.
