- St. James Parish, Louisiana. September 5, 1849. - August 30, 1850.
- Court: District
- Salutation: To the Honorable the Fourth Judicial District Court of the State of Louisiana holding sessions in and for the parish of Saint James
Abstract
Clairville Hymel represents that Henri Baudet falsely and maliciously accused him, in an affidavit before a justice of the peace, of having incited a slave named Valery to run away, and of concealing and stealing him. Hymel further claims that he was “publickly arrested” as a result of the charge and arraigned before a grand jury, although later released. Hymel contends that Valery is not Baudet’s slave but his and, inasmuch as the accusation was “without reasonable or probable cause,” he has suffered damages. He prays the court to condemn Baudet to pay the damages plus costs of suit.
Result: Partially granted.
