Abstract

Nancy Black seeks to be confirmed as separate owner and administrator of her “paraphernal” property, and she petitions for the dissolution of the community of “acquets and gains” that exists between her and her second husband, John W. Dawson. Nancy represents that, since the year 1840, she has had and continues to have the “entire administration Separate & apart” of the property adjudicated to her from the community estate of her first husband, William Bird. The property consists of a tract of land, twenty-two slaves, livestock, farm equipment, and other personal items. However, John Dawson, her second husband, has received and applied to his own use some of the revenues from her cotton crops. He has also purchased a tract of land with her money. Dawson is now in debt and, although Nancy's paraphernal property is “judicially” separate from his, she fears that her share in the community property is in jeopardy. Therefore, she wants to be confirmed owner and administrator of her own separate property. She also prays that the community property be dissolved. Furthermore, she seeks a judgment against John Dawson for the sum of $11,476.75, which represents the funds he has received and used from her separate property. Finally she claims a mortgage on Dawson’s own separate property to secure her rights.
