Abstract

Madeleine, a free woman of color, presents to the court that, on 21 February 1848, Victor Duperon, a free man of color, became indebted to her for $4,180 plus interest. To secure the debt, Duperon mortgaged a tract of land and eight female slaves: two mothers, five children, and a single woman. Duperon then proceeded, "by a public act," to transfer the mortgaged land and slaves to another free man of color named Louis Duperon, who, Madeleine alleges, officially assumed the debt. She claims that she has demanded payment from Victor Duperon and has notified Louis Duperon that the debt has remained unpaid; all "in vain." She therefore prays the court to issue a writ of seizure and sale on the land and slaves, and to order that the cash from the sale be used to satisfy the principal and interest on the debt.
