Abstract

Alley E. Ross seeks a divorce and separation in property from her husband, John R. Ross. Alley represents that she married John Ross in 1840 and lived with him until “some time during the present year 1850.” However, living with him has become “impossible and insuportable.” She charges that he has committed adultery, abused her, publicly defamed her, been habitually drunk, and engaged in violence. Fearing for her safety, she has returned to her mother’s house in Franklin Parish. She contends that she brought to the marriage, and has acquired since then, property consisting of $750 in cash, four horses, and two slaves. The horses and slaves are still part of the marriage community property, but her husband has spent the cash. In addition, he holds the horses and one of the slaves, and refuses to give them up. Alley Ross therefore prays for a judgment in the sum of $750 against her husband. She asks that the slave and horses still in his possession be sequestered. She seeks a mortgage on his property to secure her claims. Finally, she prays to be divorced “a vinculo matrimonii” from him.
