Abstract
James R. McDowell seeks to be decreed the “true and legal owner” of a slave named Jerry. McDowell contends that Jerry is “wrongfully” detained by one John W. Couch, who refuses to “surrender” him although amicably demanded to do so. Related documents reveal that Jerry has been tried and convicted of murder. He was sentenced to hang but his sentence was commuted to life in the penitentiary. He is now being held by Couch, the sheriff, on order of the state, which claims that Jerry is no longer McDowell's property but that of the state.
Result: Denied; appealed; affirmed.
