Abstract

Mary Fulshire seeks to be separated in property from her husband, John B. Scudder. Mary represents that, upon her marriage to Scudder in 1843, she owned several slaves, livestock, a corn mill, and household furniture and utensils. Since her marriage, she has inherited money from her father's estate. According to Mary, the entire property has gone into her husband’s possession and under his administration, including the slaves whom he employs in his business. Mary claims that her husband is now "embarrased in his pecuniary Affairs” and her paraphernal property is at risk. She therefore seeks to renounce the community of “Acquets & Gains” that exists between her and her husband, to recover her separate property, including her slaves, and to be given administration of her own affairs. In addition, she seeks $100 per month for the hires of her slaves, as well as payment of $2,746 for the full value of the property taken over by her husband.
