Abstract

Noël Mézières, a free man of color, seeks a writ of injunction to stop the sale of his land. Mézières represents that a court order resulting from the suit of Joseph Pérot, a free man of color, against Madeleine Pérot, a free woman of color, has commanded the sheriff to seize a tract of land assumed to belong to Madeleine Pérot and advertise it for sale. Mézières contends that Madeleine Pérot is no longer the owner of the land. Madeleine sold the land in 1837 to one Marie Louise d’Ortolan, a free woman of color, and Marie Louise sold it to him in 1847. He has thus been in peaceful possession of the land for a number of years. He therefore prays that Joseph Pérot and Saul W. Hyams, sheriff of the parish of Natchitoches, be cited to answer his suit, and he seeks an order enjoining Hyams not to sell the land. He also prays to be “quieted in his title and possession” of the land.
