Abstract

Bosman Hayes seeks damages from his brother, Isaac Hayes, whom he charges of having slandered his good name. Bosman represents that he has “always endeavored to deserve and maintain an honest, upright and unsullied character and reputation.” In the last two years, however, the good name he had previously enjoyed among all “upright and honorable men” of the parish has been threatened by the “false, malicious and scandalous and defamatory words and expressions” spoken by Isaac, directly to him or about him in the presence of freeholders and slaves alike. Isaac has specifically accused Bosman of stealing slaves and livestock, and of abetting the “running off” of slaves. In 1851, Bosman filed a suit against Isaac, which he was persuaded to drop on Isaac giving bond and promising in writing to cease and desist from his libelous activities. Isaac has recently been at it again, however, and Bosman now seeks $10,000 in damages, plus costs of suit.
