Abstract

Jean B. Bellocq of New Orleans presents to the court that he holds a promissory note in the sum of $15,197.76, subscribed in 1847 by the late Madgdeleine Oliveau, widow of the late Simon Porche, to Dr. Auguste Ferrier. The debt was secured by a "special mortgage" on Mrs. Porche's plantation located on a tract of land of eighteen "arpents" front by eighty in depth on False River in the parish of Pointe Coupée. Two years later, Mrs. Porche sold a portion of her mortgaged plantation to a free woman of color named Cecile. She died some time later, leaving the debt and the remainder of her mortgaged plantation to her "universal legatee," Victoire Virginie Esnault, widow of Sidney A. Lacoste, but bequeathing a small tract of land in "usufruct" to Cecile; a bequest now being contested by Mrs. Lacoste. After Mrs. Porche's death, Dr. Auguste Ferrier obtained a judgment against Mrs. Lacoste, forcing her to buy the mortgaged plantation and sell some slaves to pay the inherited unpaid debt. But a little over $5,000 remains unpaid. Jean B. Bellocq has now bought the note and the rights to the special mortgage from Dr. Ferrier. He is therefore suing Mrs. Lacoste and her husband, as well as Cecile, to recover the balance of the debt. He prays that the Lacostes be condemned to pay the debt with interest or that Cecile's land be seized and sold "as the law directs" [Original in English and French].
