Abstract

James W. Elam, a minor over the age of fourteen, seeks to be emancipated and allowed to administer and manage his property. James represents that he is one of the heirs of the late Lucius W. Elam and his wife, Elizabeth H. Bray. As such he has an “undivided interest” in the considerable estate left by his parents, which consists of a plantation on Little River and slaves. He contends, however, that his former tutor, the now deceased Samuel Glenn, has mismanaged the estate and the revenues are insufficient to meet the expenses. Although a new tutor, John P. Elam, has been appointed, James argues that he is fully capable of managing his own affairs and has in fact been doing so for a year. He asks that a family meeting be convened to deliberate on the propriety of his emancipation before the legal age. He also prays that John P. Elam, his new tutor, as well as his under-tutor, Simeon Thomas, be cited to appear and show cause as to why he should not be emancipated.
