Abstract
Eulalie, an elderly woman declaring herself a free woman of color and speaking on behalf of her seven children and ten grandchildren, contends that she and her family are illegally held in slavery by Daniel A. Long and Zachariah S. Mabry. Eulalie represents that she had been in the “full enjoyment of her freedom” for forty-five years in the parish of Pointe Coupée when, in late 1852, she and her family were “forcibly” seized and taken from their home. Eulalie claims that the abduction was executed at night by unknown armed persons. The family was transferred to the custody of Daniel Long and Zachariah Mabry, who now claim them as their property. Eulalie prays that the court will declare her and her family free and enjoin Long and Mabry from exercising any right or authority over them.
Result: Dismissed; appealed; reversed and remanded; retried; granted; appealed; decree on retrial sustained.
