Abstract

James Douglass seeks to recover unpaid wages from Jesse and Sarah Davis. Douglass represents that Davis, acting as head of the marriage community and manager of his wife’s affairs, hired him to overseer the couple’s plantation for the year 1854 and promised to pay him $500. Douglass contends that he started work, as agreed upon, on the 1st of January and diligently performed his duties until he was “unceremoniously” discharged from his functions on the 17th of September. Douglass asserts that, while working for Jesse and Sarah Davis, he maintained “a good discipline among the slaves” and “made a good crop;” his discharge was therefore “without cause whatever.” He seeks a judgment against Jesse and Sarah Davis in the sum of $500, plus interest at the rate of 5% per annum. He also seeks a privilege on the couple's crop and plantation to secure his claim.

Result: Partially granted; dismissed on motion of plaintiff's counsel.
