Abstract

Sarah Hill, of Nashville, Tennessee, seeks compensation for the loss of her slave named Edmund. Hill represents that, in December 1852, she placed Edmund in the hands of James White through her agents in New Orleans, "Messrs Swiney Green & Co.” White was charged with selling Edmund, a nineteen-year-old mulatto man. Hill claims that White "carelessly and with the grossest negligence entrusted” Edmund to the care of another slave and sent the two men to the “wharf or steam boat landing” in New Orleans, whereupon Edmund escaped. Sarah Hill asserts that she has advertised a reward for Edmund's capture in the public newspapers of New Orleans without success. Edmund has never been found. Hill therefore prays for an order directing White to pay her $1,500 in damages, her estimate of Edmund's value, with legal interest.

Result: Partially granted; appealed; reversed.
