Abstract

Virginie Lemelle, a free woman of color and the wife of a free man of color named Philippe Esterling, presents to the court that her father, Alfred Lemelle, the owner of two "lots of ground" and a family of five slaves, has died intestate. Since his death, the property has been in her mother's hands, "subject to be disposed in due form of Law" to her account and that of her minor siblings and co-heirs, Marie Louise and Eleontine Lemelle. Because their mother has since remarried without "qualifying as natural tutrix" of the minors, they are left without anyone to represent their interest and the partition of the intestate succession has not taken place. The petitioner thus prays that a family meeting of the "nearest relatives" be held before a duly commissioned officer "to select and recommend" a tutor who will represent the minors' interests in a suit she intends to file against her mother for the partition of her father's property.
