Abstract

Rosa Mahier, a free woman of color, presents to the court that in November 1849 Villeneuve LeBlanc Senior obliged himself to her in the sum of $5,533.92, payable in November 1850. The money was never paid. She claims that LeBlanc conspired with his children to have his entire estate seized and sold under the pretense of satisfying debts to his children, but in reality to shield himself from his creditors. LeBlanc's children purchased the property and kept not only the money owed to them but the entire amount of the purchase price. Rosa further alleges that, after LeBlanc's death, none of the legal and usual succession proceedings took place, and none of his creditors were paid. She is therefore suing Villeneuve LeBlanc Junior, his brother Octave, his sister Virginie, and Virginie's husband Augustin LeBlanc. She prays that the sale of Villeneuve LeBlanc Senior's property to his children be annulled and that the entire estate be declared part of his succession, and thus liable to the claims of his creditors, including her claim of $5,533.92 [Original in French].
