Georges Chevalier, a free man of color, seeks to collect a debt from Jacques Jacquey, a free man of color. Chevalier is the "bona fide owner and holder of five promissory notes" from Jacquey worth a total of $690. In 1853, Jacquey signed a public act whereby he secured payment "by special mortgage" on a tract of land. Jacquey also agreed to be charged 8% interest on the notes. The notes are now past due. Consequently, Chevalier prays for an order directing the sheriff to seize and sell Jacquey's mortgaged land in order to satisfy his demand.
