Abstract

Sarah Jane Kitcher seeks compensation from her husband, Henry T. Spann, for the sale of some of her property. Sarah avers that she married Spann in 1852 and that, since that time, he has received and "taken charge of" her separate paraphernal property and used it "for his own use & benefit." This property includes cotton and cattle, which Spann has sold for profit, and a slave named Will, whom Spann now holds under his authority. Sarah asserts that Spann "refuses to pay her the said sums of money received & realized by him from the said sale of" the cotton and cattle. Further, Spann is now insolvent, "so much so as to jeopardise" her property rights. In consequence, Sarah prays for a judgment against her husband for $1,250 plus 5% interest "and that the community of acquits and gains heretofore existing between them be Dissolved," thus restoring her to feme sole status.
