Petition #20980719

Abstract

Elizabeth Courtenay, executrix of the estate of her late husband Robert, maintains that Robert sold Edward Carr a slave named Polly as a six-year term slave in 1804. She notes that "by the terms of sale, the said E. Carr was not to take, or sell the time of the said Woman out of the State of Maryland during her said servitude." Now Courtenay claims that Carr has assigned title of the slave to either James Bryden or Bryden's daughter, Violet Bhenn, who, she fears, plans to move with Polly "to parts unknown." Courtenay asks for an injunction to prevent the defendants from removing the slave from the state and for an order requiring them to appear in court to answer her complaint.

Result: Partially granted.
