Lucy Roe, a free person of color representing herself and her infant, James Roe, states that James Roche, administrator of the estate of her late husband, James Roe, has sold a slave named Daphne without the permission of the estate. Lucy Roe adds that the return submitted by Roche shows a balance of about $90 due to the heirs. However, Roe contends that if the estate were "fully & honestly administered" it would produce a much larger balance. Roe asks the court to order Roche to pay the proper balance. The defendant's response questions Lucy Roe's claim that she is a free person of color and, in fact, asserts that she and her son were the slaves of Stewart Brown of Baltimore at the time of the death of the intestate.
