- Salutation: To the honorable William Kilty Chancellor of Maryland
Abstract
Mulatto Philip Darnall asks that the court appoint a new trustee for the estate of his uncle, Richard Darnall. Philip states that Richard directed that Henrietta, Nathan and Benjamin James along with "a negro woman" Araminta "take and use the rents & profits ... during their lives [to a] part of a tract of land called Portland Manor." Upon their death, Portland Manor reverted to Bennett Darnall and his heirs. Philip reports that the said Bennett, brother of Richard, was the previous trustee and he has since died, leaving Nathan James and Araminta as the only devisees still living. As the son and heir of Bennett Darnall, Philip states that he is "entitled to the reversion of the Said trust" and is "materially interested in the preservation of the Said property." He asks the court to order the appointment of a new trustee.
