Abstract

Robert Franklin, administrator for the estate of the late, intestate Nicholas Norman, petitions the court to help recover a debt of £213.13.11 owed to Norman by John Deale. Franklin explains that a court-ordered sale of slaves and other property owned by Deale has been carried out and Norman's estate has been repaid for a mortgage secured by that property. Franklin now states that Deale owed this second debt to Norman and "that it was the intention of the parties that the Bond debt should be secured by the mortgage & tacked to it." As there is still money in the account of the trustee overseeing the sale, and as Deale "hath since applied for the benefit of the Insolvent Laws of this State," Franklin asks the court to order Deale to appear in court and to grant permission to have Deale's debt to Norman paid using funds from the trustee's account.

Result: Granted.
