Abstract

James Tongue asks the court to issue an injunction prohibiting Bennett Sollers from taking further action against him with regards to the purchase of a slave. Tongue states that he issued a note for the purchase of a male term slave in the amount of $220 to James Dixon who was acting as the agent for his father, Benjamin Dixon. Following Benjamin Dixon's death, Bennett Sollers, executor for the estate, brought suit against Tongue and won a judgment resulting in a levy on Tongue's property. Tongue charges that no credit was given for the $20 he had paid and that, in fact, the slave had been sold to John Fitzhugh and Joseph Wilkinson prior to his purchase.

Result: Partially granted; dismissed.
