Abstract

William Carroll, Elizabeth Carroll, and Jane Fitzgerald ask the court for a fair distribution of the slaves belonging to the estate of Ann Diggs. The petitioners state that Ann Digges specified in her will that the slaves of her estate should be granted to her brother Thomas A. Digges until his death at which time the slaves would become the property of Elizabeth and Jane. During the lifetime of Thomas A. Digges, the slaves in question had a total of thirty-three children. The petitioners charge that Thomas A. Digges, who wrote Ann Digges' will, "fraudulently or by mistake" failed to include the provision that the slaves should remain in families when they are distributed between Elizabeth and Jane. The slaves and their increase are currently in the possession of the defendant, William Dudley Digges. The petitioners request that the slaves be put in their rightful possession or that they be compensated for their value.
