Sally Toogood claims that her former owner, Peter Gardner, freed her by deed of manumission. She also claims that before her manumission, Henry Toogood, Sally's father, attempted to buy her. Sally alleges this transaction was not valid. However, she is being held in custody and is in danger of being sold in order to repay Henry Toogood's debts. Sally asserts that she is entitled to her freedom, that she is not the property of her father, and asks the court for an injunction preventing the proposed sale.
