Abstract

Ann W. Wood purchased a slave named Clarissa from William Strickland on credit. Clarissa had previously belonged to John Perrie and, according to his will, she was to be manumitted when she reached 21 years of age. Wood claims that Clarissa was already older than 21 when she bought her. She alleges that, unlike Strickland, she was ignorant of the terms of the will. Strickland transferred her credit note to Thomas Bruce, who, according to Wood, also knew the terms of the will. The petitioner reports that Bruce obtained an order directing her to pay off the credit note. In the meantime, Wood informs the court that Clarissa has petitioned for her freedom. The petitioner asks for subpoenas to be issued to Strickland and Bruce so that they may answer her charges. She also seeks an injunction to stop the order requiring her to pay Bruce, until the court rules on the issue of Clarissa's freedom.

Result: Granted; injunction dissolved; transferred to chancery; continued.
