Abstract

The late Ann McCanley bequeathed property to George W. Higgins, his wife Anne, and their three children. The court appointed Thomas H. Dorsey and Thomas W. Hall as trustees "to carry into effect the provisions of the will ... for the benefit of the said George and Ann his wife and their children." During a previous case, the court ordered the trustees to sell certain slaves "for the use" of the heirs. A recent audit of the accounts revealed that the trustees' expenditures on behalf of the Higginses "have exceeded their Receipts by a very large sum of money." In order to reimburse Dorsey and Hall for their expenses, the petitioners ask permission to sell slaves not necessary for the maintenance of their property. They append a list of twenty-three slaves, mainly children under the age of fifteen, whom they propose to sell.
