Abstract

Thomas Watkins informs the court that he has been awarded a judgment against defendant John H. Wells. In order to pay the judgment, Wells proposed selling his slave, Charles, who was in the custody of George McMer, another of Wells's creditors. McMer and Richard Williams, the officer also acting as Watkins's agent, struck a deal to sell Charles and to divide the proceeds. Williams confined the slave to the Common Gaol of Anne Arundel County and secured a purchaser. The petitioner charges that McMer has conspired with a certain James Williamson and has conveyed his right in the slave to Williamson, thereby ignoring the levy on the slave. Asserting that he is entitled to possession of Charles because Wells also owes him a debt, Williamson refuses to have Charles sold for their "common benefit." Watkins asks the court for relief in this dispute and for subpoenas to be issued.

Result: Dismissed.
