Abstract

Thomas Gibbs asks the court to require Elizabeth Clagett and Richard Henry Clagett to give an account of their transactions with regards to the slaves Austin and Sally. Gibbs states that in 1830 he won a $1056 judgment against Elizabeth Clagett and some of her property was seized and sold to pay the debt. Gibbs purchased two of Clagett's slaves at the sale, but charges that, prior to the judgment against her, she had sold the slaves and all of her property to Richard Henry Clagett in order to "defraud" Gibbs and "prevent him from obtaining any benefit of the said decree." Gibbs charges that although he has purchased Austin and Sally, Richard Henry Clagett continues to hold them as his property.

Result: Partially granted; dismissed.
