Charles E. Benson submits that Eliza Roberts, a free woman of color, placed her orphaned niece named Mary in his service last September. Benson maintains that Mary was supposed "to remain with and serve your petitioner as long as he should desire, on condition that he should provide for and supply her ... with suitable food and clothing." The petitioner reports that Eliza recently came and took Mary away from him. Claiming that Eliza is "incompetent to maintain and provide for her," Benson asks the court to compel Eliza to return Mary and to bind Mary legally to him.
