Abstract

In 1841 George W. Lawrence and Enoch Sheckell became sureties for a payment of three hundred dollars that William Drury owed Somerville Pinkney. In exchange, Drury mortgaged two slaves, Minta and Susan, to save himself and indemnify the petitioners. Two years later they not only have not been compensated for the loan but now are facing suits instituted against them for the payment of Drury's debt. The petitioners also explain that five years earlier Drury mortgaged Susan along with a crop of tobacco to Nicholas Owens. The petitioners state that this debt has been repaid and therefore Susan can no longer be held liable as collateral. They ask the court to order that Minta and Susan be sold and the proceeds of the sale used to pay Drury's debts. They further request that the court issue an injunction prohibiting the trustees for Drury and Owens or Pinkney's administrator from taking further action regarding the slaves.

Result: Partially granted.
