Abstract

On 16 April 1846 Rebecca Whittington mortgaged fourteen slaves to Richard G. Mackall to secure a loan of "sundry sums of money." They agreed she would retain possession of the slaves until "the due and legal authentication and presentation of his claims." Whittington alleges that Mackall "illegally forcibly and fraudulently" took possession of her slaves and sold them for $2600 to Edwin W. Duvall. The petitioner claims that, without the labor of the slaves, she cannot cultivate her crop of corn and tobacco and will be further unable to repay her debt. She asks for an injunction to prevent Edwin W. Duvall, Richard G. Mackall, and James Donovan, a slave trader to whom Duvall has since sold the slaves, from selling her slaves out of state. She further asks the court to force the defendants to return her slaves to her until she can dispose of them "in a due course of legal or equitable proceeding" in order to compensate Mackall.
