Abstract

Levi L. Tayman bought a family of four slaves from John and Lucy Mitchell, administrators of the estate of James Mitchell, at a private sale held in May 1848. Tayman says that the Mitchells knew that the slaves were "permanently diseased" and only worth $750, but they fraudulently represented that the slaves were appraised at $1200 and were of "sound and healthful constitution." To pay for the slaves, Tayman transferred to the Mitchells two notes worth $1961.14 with the excess to be refunded to him when they were paid. Tayman seeks to have the sale "set aside as fraudulent" and asks that the Mitchells "may be required to take back the said negroes" and return his notes.
