Solomon G. Chaney petitions the court as executor of the estate of Elijah Chaney and trustee of Elijah's granddaughter and one of his heirs, Henrietta Groves Chaney, infant daughter of Levi Chaney. A clause in Elijah's will stated that if Henrietta died before her sixteenth birthday, her portion of the estate would go to any other lawful issue of Levi Chaney. Henrietta died in 1838 before her sixteenth birthday and Levi died in 1848. During this period, Solomon Chaney disbursed the interest and profits of Henrietta's estate trust. After Levi's death, Solomon Chaney continued to pay the disbursements to Levi's widow and second wife, Violetta Chaney. Now there is a dispute over the legitimacy of Levi Chaney's marriage to Violetta Chaney and the children from that marriage. Solomon Chaney asks the court to decide which children are entitled to portions of the estate. He also asks that his trusteeship be transferred to Shelby Clark, the guardian of some of the Chaney's children from his first marriage.
