Abstract

Salathiel Cole, executor for the estate of the late Artridge Cole, sold Rachel, a slave belonging to that estate, to G. W. Lurman at a public auction. Cole contends that Rachel "was believed and represented to be sound, and sold under such representations." After the sale, Lurman had Rachel examined by a doctor and discovered that she was not healthy. Lurman will not keep Rachel and "is desirous that the contract of sale shall be cancelled." Cole agrees and asks the court to void the previous sale and to permit him to sell Rachel again "without restricting the purchaser to the State of Maryland."

Result: Granted.
