Abstract

Rachel Thompson received two slaves as a gift from her father, William W. Smith, in 1833. Smith believed that his daughter would own these slaves in her own right, separate from her husband's property. Samuel Thompson, Rachel's husband, acknowledged "often times and to divers persons" that the two slaves belonged solely to Rachel. In 1839, a circuit court in Mississippi levied a judgment against Samuel Thompson and James Smith. The judgment awarded $606 plus court costs to John Hannon. Hannon secured a writ of fiere facias against Thompson's property including Rachel's slaves. Rachel made an attempt to protect her slaves but a jury ruled against her. She asks for a writ of injunction prohibiting the sale of her property to satisfy the judgment against her husband.
