Abstract

John C. Hicks states that Sarah Waters, his wife Ann's mother, wished to give his children a portion of her land and slaves. In 1836 Waters executed a deed of trust to accomplish this with Hicks acting as trustee. Hicks was given the power to sell the slaves whenever he thought it would be best for the children. Hicks used the slaves to raise crops and with the proceeds he bought more slaves. He contracted with Thomas Amason and Blake Little to sell them 18 slaves but the contract was cancelled. After Amason died, James Hibler and George Amason claimed the slaves as belonging to Thomas Amason's estate. Hicks hired some slaves to Blake Little in 1843 and Little sold two of them to Samuel Butler without Hicks's knowledge or consent. Hicks seeks to have his title to his children's slaves acknowledged and he asks that Butler return the slaves to him, along with the proceeds of their hire.
