Abstract

Ophelia Ford Carter, by her next friend Oscar F. Holmes, asks the court to prevent David L. Carter, Harvy D. Smith, and Ferdinand C. Ford from removing slaves that she claims as her own from the jurisdiction of the court. She also asks the court to assume management of the slaves and hire them out for her support until their ownership is determined. Ophelia states that she owned the slaves and other property at the time of her 1841 marriage to David L. Carter. The Carters separated in October of 1846, agreeing that Ophelia could maintain her property in trust. Now she charges that David has "wrongfully & Fraudulently" taken possession of the slaves. She further states that she is destitute and without means of support.

Result: Granted; appealed and reversed; granted.
