Gray Chandler executed a deed of trust Aderton Boykin, to secure money he owed to the partnership of Norris Stodder & Co., of which Boykin was one of two trustees. The said deed of trust "conveyed to the said Trustees fifteen negro slaves to be sold according to the provisions of the said deed to pay said money upon default of its nonpayment"; Dave was of one the said slaves so mortgaged. Boykin and the other trustee resigned, and John Tapp "was appointed trustee in said deed in the place of said Trustees." Boykin then purchased thirty-four-year-old Dave from Chandler. Stating that Tapp has been ordered to sell the slaves at public auction to satisfy the debt, Boykin fears that Dave will be sold as well. He therefore asks for an injunction to stop the sale of Dave.
