Charles Montgomery gave five slaves to his daughter Nancy sometime after her marriage to James L. Graves in 1850; when Charles died, Nancy received five additional slaves from the estate. Nancy has since died and the executors of Charles's estate maintain that these slaves should revert to his estate. However, Nancy's husband retains control of the slaves, asserting that they belong to him as her sole heir. The executors state that these slaves are "family servants of peculiar value" and that they should be returned "among their relatives and family." Furthermore, the executors fear that Graves will remove them from the state. They ask that the sheriff take possession of the slaves and that Graves be required to pay the estate for the time the slaves have been in his possession.
