Abstract

The heirs and widow of William Clayton represent that the said Clayton devised certain slaves and lands to his widow Susanna "to be used occupied and enjoyed by her during the term of her natural life, and after the death of the said Susanna, to be equally divided amongst the rest of said complainants." The petitioners attest that the said Susanna "is very aged and infirm and is unable to carry on the farm of the said deceased, and the interest is too small to justify the necessary expense of employing an overseer to carry on the same." They further aver that "it would be to the interest of all parties concerned" to sell said property and place the money "at interest first to support and maintain the said Susanna during the term of her natural life, and the surplus of the interest to be again invested so as to accumulate for the benefit of those entitled to the remainder after the life estate of the said Susanna." The petitioners therefore pray "that said property be sold upon such terms and conditions as to your Honor shall seem meet."
