Abstract

James S. Carradine states that, as son of the late Louisa Smith Carradine, he is the rightful owner of slaves left in trust for Louisa, and her heirs, by Thomas Rowan in 1833. James explains that his father died intestate in 1854, leaving all of the 38 slaves except Frank, Aleck, and Sandy, in the possession of his second wife, Mary Carradine, who claims the slaves as her own. Mary Carradine married the petitioner's father in 1836 and had five children who are also defendants. James S. Carradine thus asks that the defendants answer the charges, return his slaves, and pay the yearly value of his slaves since the death of his father. He also asks for an injunction prohibiting the removal of the slaves from the jurisdiction of the court and for the sheriff to hold the slaves in his custody until the case is settled.
