Burr A. Harrison, executor of the will of the late George H. Foote, states that he sold a slave named London to Augustus Roby in 1856. Harrison claims that Roby agreed to pay him $950 for the slave over a period of months; Roby died before he was able to complete the agreed upon payment schedule. Citing that Jane C. Roby purchased London from Augustus's estate, the petitioner claims that his deal with the late Augustus should be treated as a mortgage and that he therefore should be awarded relief from Jane C. Roby. Harrison asks that London be sold so that he might receive the proceeds as payment of the mortgage.
