Abstract

In 1848, Robert W. Mayrant inherited two slaves, Lucinda and Milly, from his mother Mary E. Mayrant. Because Robert was still a minor, Lewis Brewer applied to become his guardian and received the slaves. In December 1848, Robert borrowed one thousand dollars from Brewer and "entered into business." Brewer agreed to hold the two slaves as security and to allow a reasonable hire for their labor. Over the next seven years, Mayrant and Brewer discussed selling the slaves to Brewer, but they never agreed on a price, so Brewer kept the slaves, "acting as agent for your orator." Brewer died in 1855 and Tyre J. Spann qualified as executor. Mayrant asserts that the hire of the slaves "has been sufficient to pay off all of said $1000 & Interest." Mayrant asks the court to subpoena Spann, to determine what amount remains unpaid (if any), and to decree the return or sale of the slaves.
