Abstract

Pierre Chouteau asks that legal proceedings instituted against him by Pierre Duchoquette be stayed. He represents that, in 1810, Genevieve Charleville, Duchoquette's estranged wife, received from her mother, Francis Brazeau Charleville, a five-year-old mulatto slave named Philip. On the same day, she mortgaged Philip and a plot of land to Pierre Chouteau in order to secure a debt incurred for the purchase of a parcel of land. Genevieve never paid the debt and retained possession of Philip until her death. Upon her death, her son law, Tomas Consoles, took possession of and "sold" Philip to Chouteau to settle the debt. However, Genevieve's estranged husband, Pierre Duchoquette, has now obtained a judgment against Chouteau for recovery of Philip. Chouteau therefore prays that "the said Pierre may be enjoined from further proceeding against your orator upon the said Judgment and that your orator shall have such further and other relief in the Premises as to this Honorable Court shall seem meet."
