Abstract

Arthur Tyner asks the court to issue an injunction prohibiting Wright Allen and George W. Powell from selling slaves mentioned in a deed of trust. Tyner further asks that the bond and deed of trust involved in the conveyance be considered void. He was deceived into conveying eight slaves in his possession to the defendants while he was "absolutely drunk and wholy unfit for business." He further states that he does not remember executing the bond or the deed of trust because of a state "caused by the excessive use of ardent spirits." Tyner charges that he was taken advantage of because "he is an illiterate man" and was unable to read what he was agreeing to. Allen and Powell are "endeavoring" to take possession of the slaves and sell them.
