Abstract

In 1842, at the time of her marriage, Martha Smith conveyed her property, including several slaves, as a trust estate to Barnes G. Clark for "the use and benefit" of her new husband, Josiah Parker. In 1843, a year after their marriage, Josiah decides to "remove to a southern state" but Martha refuses to go. After a bitter dispute, she and her slaves left him and took up residence with Barnes Clark. Josiah argues that he should receive profits from the crop recently cultivated, and profits from the future hiring out of the slaves, and renting of the land. He is also entitled to "all the interest and profits which have accrued" from the trust estate. Finally he seeks an account of all the sale and purchase of slaves since the marriage.
