Abstract

During the 1850s, David McMasters sold to Joshua Stanly a slave named Daniel Jones, with the understanding that Daniel could control his own time and use the fruits of his labor working in his "buggie business" to repay Stanly for the privilege of living free. Later, Daniel Jones purchased a jack ass on credit from Marmaduke Swain, and hired Samuel V. Barker to transport the jackass and a buggy to South Carolina for sale, for which services Barker would receive $25 compensation. Upon Barker's return from South Carolina, part of the money he had received from the sale became a matter of dispute. Following Joshua Stanly's death, his widow Abigail claimed Daniel Jones as part of the estate, and sought to collect the money made by him as her slave. Marmaduke Swain on the other hand claimed the money as payment for the jackass purchased on credit by Daniel Jones. Barker contends that he would "Cheerfully" hand over the money if he knew to whom it should go. He brings suit, arguing that he cannot pay both parties.
