In 1840, Henry E. Lane, a merchant in Buncombe County, borrowed two thousand dollars from a friend, Arthur Blake of South Carolina, putting up as collateral seven slaves. Retaining possession of the slaves, Lane was unable to repay the debt. Blake, a planter in "easy" circumstances, claims that, out of friendship and kindness, he never called in his note over the many years that have passed. Now, however, Lane has become insolvent, has sold some of the mortgaged slaves, and plans to sell others. Arthur Blake and his security file suit.
Result: Rejected.
