About 1854, Mary and John Hubbard, who were born free, obtained a marriage license from the Alamance County clerk of court and were married by a justice of the peace. After 1857, Mary testifies that John began to "ill-treat, beat, whip and abuse her;" he later became intimate with a woman named Emily, formerly the property of Tobias May and now a free woman. Mary claims that her husband continues to be intimate with the said Emily and cohabits with her. Mary asks for a divorce.
